By confirming that you wish to move to the next stage of your project, you agree to accept the Terms & Conditions set out below which shall apply throughout the project.
1. DECISION MAKING
The client is wholly responsible for making the final decisions regarding the project. The role of KFD Interiors is to share expertise, opinions, resources, and suggestions. However, it is up to the client to decide which, if any, to act upon. KFD Interiors excludes all liability for final decisions made by the client.
2. DESIGN FEES
2.1 INITIAL CONSULTATION
Our initial consultation fee is $375 plus GST - this working appointment is scheduled for 90 minutes long where we discuss your brief and determine the scope of work. At this meeting we supply you with valuable information, providing you with clarity and direction for your project.
2.2 DESIGN PHASE
For new build / renovation specifications and furniture / furnishing projects, once we have agreed a full scope of work, we price up a bespoke package of services for the client to cover the Design Phase of a project. This package includes overall concept planning, sourcing and specifying the agreed items and providing the necessary quotations.
If you choose to work with us on a package, 60% deposit will be invoiced to commence the project. The remaining balance of 40% will be invoiced seven days after we have presented all the requirements for a project, or 3 months from the commencement of the project - whichever date falls first. The term of a package of services ends once the balance invoice has been sent.
Time required for any additions or alterations made after the balance invoice has been sent will be charged at $185 per hour plus GST.
2.3 DRAWINGS & RENDERS
Drawings and renders are optional but will help to visualise design features, giving the client a clearer picture of the design and layout. These drawings / renders are not a substitute for the CAD drawings required by cabinet makers to ultimately produce the cabinetry. Drawings and renders are charged at $120 per hour plus GST.
2.4 DOCUMENTATION
Specifications and other documentation for the build team and trades are also optional and are charged at $120 per hour plus GST.
2.5 ADDITIONAL CHARGES
Additions to the scope of work - Work requested that is in addition to the original scope of work is charged at $185 per hour plus GST.
Additional meetings - All meetings other than those specified in our packages (which includes the initial consultation and key presentations) are charged at $185 per hour plus GST. These include all meetings with you the client, visits with you to suppliers, site visits and collaborations/meetings with architects, cabinet makers, contractors, and tradespeople.
Surcharges - KFD reserves the right to charge a 20% surcharge for urgent jobs that fall outside of the usual delivery timeframes.
Mileage - KFD Interiors does not charge a travel or mileage fee for our initial consultation or meetings covered by a package of services. For other visits to our clients or their building sites, we charge a call out fee of $75 + GST to cover travel time and mileage. And for locations outside of our immediate catchment area of the North Shore or Central Auckland, we will also charge mileage at the current IRD Tier 1 rate.
3. SALES OF PRODUCTS, DELIVERY AND INSTALLATION
All prices quoted are exclusive of GST, unless otherwise stated. The client agrees to pay goods and services tax on all products as per KFD Interiors invoices.
Quotes for all products are valid for seven days, after which time for re-quoting or re-specifying will be charged at $185 per hour plus GST. This is due to the ever changing nature of supplier stock and pricing.
An invoice will be provided upon acceptance of the quote via email. Full payment is required before any order is placed through our suppliers. For items that require a wait of longer than four weeks for delivery, the client will be invoiced 60% upfront and the balance before delivery. Note: Products are not secured with suppliers until a deposit or full payment is made.
Any orders placed by KFD Interiors for products, including fabric, tiles and wallpaper are non- refundable and non-exchangeable,
In some instances, where we are not making a margin on the product, we may receive a small commission from the supplier.
Delivery and freight are on-charged at cost. They may not always be quoted at the time of ordering as they are often weight and volume dependant, finalised at the time of dispatch.
KFD Interiors cannot be held responsible for delivery delays beyond our control, like shipping delays, material shortages, etc.
The client is required to ensure the site is ready for any deliveries or installation on the confirmed date. The client will be liable for any cancellation fee charged by the relevant supplier.
When goods are delivered to the client’s property, please ensure they are checked thoroughly before being accepted and signed for. KFD Interiors cannot be held responsible for any loss or damage to items identified after delivery has taken place. If KFD Interiors is required to accept deliveries on your behalf and / or unpack and install, time will be charged at $185 per hour plus GST.
4. PAYMENT
All payments are due within seven days from the date of invoice. The client may be liable to pay interest on invoices not paid by their due date at a default rate of 10% per month for the period beginning on the due date and ending when the invoice is paid in full by the client (including any accrued interest). The client may also be liable for all loss, costs and expenses, including legal costs that KFD Interiors may incur as a result of any failure to pay the invoice on time. KFD Interiors shall not be obliged to perform services or provide further any deliverables until outstanding amounts are paid in full.
5. THIRD PARTY SERVICES AND MATERIALS
If the client decides to work with a third party or tradesperson based on our referral (for example an electrician, kitchen manufacturer, carpet supplier), they will need to contract directly with that supplier/tradesperson and the workings of that relationship will be entirely separate from the relationship with KFD Interiors.
Please ensure the appropriate insurance is in place to cover any damage that may be caused by any suppliers while carrying out services arranged by KFD Interiors, builders or the client. KFD Interiors does not accept liability for loss caused by third parties and you will need to make any claims directly to the supplier concerned.
6. LIABILITY AND WARRANTY
KFD Interiors has no liability to the client for any loss, damage, costs, expenses, or other claims for compensation arising from any information or instructions supplied by you the client which are incomplete, incorrect or inaccurate.
KFD Interiors shall not be liable for any failure to perform its duties due to circumstances beyond its control, including without limitation, flood, fire, earthquake or otherwise adverse weather conditions.
KFD Interiors does not warrant against fading of any finishes or oxidation of any products. Variations in colour are inherent to some finishes and finishes may vary in tone, colour and texture.
KFD Interiors will not be held responsible for any fabrics or materials that may stretch, shrink or react to weather conditions or incorrect cleaning.
If you choose to have items recovered, altered or repaired, then these leave your premises at the client’s risk.
KFD Interiors will not be held responsible for any fixtures or fittings supplied by the client.
Should any issues arise relating to any services, please provide full details in writing to KFD Interiors within seven days of the supply of the relevant services.
7. CANCELLATION AND TERMINATION POLICY
The client has the right to terminate this agreement at any time by giving written notice to KFD Interiors. You the client shall remain liable to pay KFD Interiors for any services provided to the date of termination. This also includes (but is not limited to) the cost of goods and materials supplied or ordered on your behalf and any services that may incur a cancellation fee.
KFD Interiors has the right to terminate this agreement on reasonable notice if you breach any of its terms or act in a way that we consider is incompatible with our continued performance under our agreement.
8. CONFIDENTIALITY & PRIVACY
Neither KFD Interiors or the client will disclose or communicate to any third party any confidential information unless KFD Interiors provides its prior written consent or the client provides prior written consent. Your personal details and the location of your project will remain confidential.
9. NEW ZEALAND LAW
These terms and conditions will be governed by and construed in accordance with the laws of New Zealand and the parties irrevocably submit to the exclusive jurisdiction of the courts of New Zealand for any matter arising under or relating to these terms and conditions.
